Terms of Service

Welcome to Lawn2Snow. These Terms of Service ("Terms") govern your access to and use of the Lawn2Snow mobile application, website, and related services (collectively, the "Platform") operated by BSCANNED INC. ("Company", "we", "our", "us"), a corporation registered in Alberta, Canada.
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Service Description
Lawn2Snow is an online marketplace that connects customers seeking lawn care and snow removal services ("Customers") with independent service providers ("Providers"). The Platform facilitates the discovery, booking, communication, and payment for these services.
Important: Lawn2Snow is a technology platform, not a service provider. We do not perform lawn care or snow removal. We facilitate the connection between Customers and Providers.
2. Eligibility
- You must be at least 18 years of age to create an account and use the Platform.
- By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement.
- Providers must have valid legal authorization to work in Canada, where applicable.
3. Account Registration
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately of any unauthorized use of your account.
- One account per person; duplicate accounts may be terminated.
4. Provider Relationship
4.1 Independent Contractor Status
Providers on the Lawn2Snow Platform are independent contractors, not employees, agents, or representatives of BSCANNED INC. Providers:
- Control how, when, and where they perform services
- Set their own availability and service areas
- Use their own equipment and supplies
- Are responsible for their own taxes, insurance, and compliance with applicable laws
- May accept or decline any job at their sole discretion
4.2 Provider Obligations
- Perform services in a professional and timely manner
- Maintain appropriate equipment in safe working condition
- Carry adequate personal liability insurance where applicable
- Complete identity and document verification as required by the Platform
- Comply with all municipal, provincial, and federal regulations
5. Platform Fees and Payments
5.1 Platform Fee
Lawn2Snow charges a platform fee of 20% on the total service price for each completed booking. This fee is automatically deducted before Provider payouts and covers payment processing, platform maintenance, customer support, and marketing.
5.2 Lead Incentive Program
Providers may earn a $2.00 CAD incentive for each qualified lead that converts into a completed booking, subject to the following conditions:
- The lead must be a new customer who has not previously used the Platform
- The booking must be completed and paid for in full
- Incentives are credited to the Provider's account balance
- BSCANNED INC. reserves the right to modify or discontinue the lead incentive program at any time with reasonable notice
5.3 Payment Processing
- Payments are processed through our third-party payment partners, including Square and Stripe.
- Customers are charged upon booking confirmation or service completion, depending on the service type.
- Provider payouts are processed according to the payout schedule displayed in the app.
- All prices are in Canadian Dollars (CAD) unless otherwise stated.
- You agree to the terms of service of our payment processors when making or receiving payments through the Platform.
5.4 Taxes
Providers are solely responsible for reporting and remitting any applicable taxes (including GST/HST, income tax, and any other obligations) arising from their use of the Platform. BSCANNED INC. does not withhold taxes on Provider earnings.
6. Booking and Cancellation
6.1 Booking
- A booking is confirmed when a Customer submits a service request and a Provider accepts it.
- Both parties agree to honour confirmed bookings.
6.2 Customer Cancellation
- More than 2 hours before scheduled service: Full refund, no penalty.
- Less than 2 hours before scheduled service: A cancellation fee of up to 50% of the service price may apply to compensate the Provider for their time.
- No-show: If a Customer is not available or the service location is inaccessible, the full service fee may be charged.
6.3 Provider Cancellation
- Providers may cancel a booking with reasonable notice.
- Repeated cancellations may result in reduced visibility on the Platform, temporary suspension, or account termination.
- Providers who cancel without adequate notice may receive negative performance ratings.
6.4 Weather-Related Cancellations
Bookings may be rescheduled without penalty due to severe weather conditions (e.g., extreme cold warnings, thunderstorms, unsafe conditions). Both parties are encouraged to communicate through the Platform's messaging feature to arrange a suitable alternative time.
7. Service Standards and Disputes
7.1 Quality Expectations
Providers are expected to deliver services that meet reasonable quality standards. Customers may rate and review completed services. Consistently low ratings may result in account review or suspension.
7.2 Dispute Resolution
- Step 1: Customers and Providers should first attempt to resolve disputes directly through the Platform's messaging feature.
- Step 2: If unresolved, either party may submit a dispute to Lawn2Snow support at brandon.thomas@bscanned.com. We will review the dispute, including any before/after photos and communications, and issue a determination within 7 business days.
- Step 3: If still unresolved, the dispute shall be submitted to binding arbitration in accordance with the arbitration rules of the ADR Institute of Canada, conducted in Calgary, Alberta.
7.3 Refunds
Refunds for unsatisfactory service are handled on a case-by-case basis. Lawn2Snow may, at its sole discretion, issue a full or partial refund or credit to the Customer. Before/after photos taken by Providers through the app may be used as evidence in refund determinations.
8. AI Features and Automated Processing
The Platform uses artificial intelligence and automated processing for certain features, including:
- Document verification: AI-assisted review of Provider identification and insurance documents
- Receipt scanning: Automated extraction of information from uploaded receipts
- Chat assistant: AI-powered customer support chatbot for common questions
AI-generated outputs are provided as aids and may be reviewed by human operators. You acknowledge that AI features may occasionally produce inaccurate results, and BSCANNED INC. is not liable for decisions made based solely on AI outputs.
9. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Provide false, misleading, or fraudulent information
- Circumvent the Platform to arrange or pay for services directly, thereby avoiding Platform fees
- Harass, threaten, or abuse other users
- Attempt to interfere with the Platform's operation or security
- Create multiple accounts to abuse promotions or the lead incentive program
- Scrape, collect, or harvest user data from the Platform
- Use the Platform to solicit users for competing services
10. Account Suspension and Termination
10.1 By BSCANNED INC.
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Receiving consistently poor ratings or multiple complaints
- Extended inactivity (24+ months)
- Any conduct that harms the Platform, its users, or BSCANNED INC.'s reputation
10.2 By You
You may terminate your account at any time by:
Outstanding payments or obligations must be settled before or upon account termination.
11. Intellectual Property
- The Lawn2Snow name, logo, app design, and all related intellectual property are owned by BSCANNED INC.
- You may not reproduce, distribute, or create derivative works from any Platform content without our written permission.
- By posting content (reviews, photos, etc.) on the Platform, you grant BSCANNED INC. a non-exclusive, royalty-free, worldwide licence to use that content in connection with operating and promoting the Platform.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- BSCANNED INC. provides the Platform on an "as is" and "as available" basis, without warranties of any kind, express or implied.
- BSCANNED INC. is not liable for the quality, safety, legality, or timeliness of services performed by Providers.
- BSCANNED INC. is not responsible for any property damage, personal injury, or loss arising from services booked through the Platform.
- BSCANNED INC. shall not be liable for indirect, incidental, special, consequential, or punitive damages.
- BSCANNED INC.'s total aggregate liability for any claims arising from your use of the Platform shall not exceed the lesser of $500 CAD or the total fees paid by you to BSCANNED INC. in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless BSCANNED INC., its directors, officers, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of or conduct on the Platform
- Your violation of these Terms
- Services you perform or receive through the Platform
- Your violation of any third-party rights or applicable law
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any legal proceedings arising from these Terms shall be brought exclusively in the courts located in Calgary, Alberta, Canada, and you consent to the personal jurisdiction of such courts.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via in-app notification or email for significant changes
- Provide at least 14 days' notice before material changes take effect
Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Platform and delete your account.
16. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and BSCANNED INC. regarding the Platform.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Force Majeure: BSCANNED INC. shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures.
